Terms and Conditions — EchoNomadLyric

1. Custom Song Creation Process

1.1 Story Submission

Clients must provide complete and accurate details through the EchoNomadLyric submission form or consultation. Incomplete or inaccurate information may cause delays or limit creative execution.

1.2 Creative Process and Review

Depending on the selected package tier, clients may receive preview drafts or early concept samples. Feedback must be clear and consolidated to maintain production flow.

1.3 Final Approval and Delivery

Final approval is required before mastering and delivery. Songs are provided digitally in MP3 and WAV formats.
Physical items (such as USB drives, printed artwork, or merchandise) are only included if explicitly agreed upon in writing.

1.4 Production Timeline

Typical project turnaround is 4–8 weeks from approval, depending on project complexity, scheduling, and client responsiveness. Rush options may be available for an additional fee.

2. Satisfaction and Revisions

2.1 Creative Subjectivity

EchoNomadLyric is dedicated to producing meaningful, high-quality creative works. However, music and emotion are subjective art forms. Complete satisfaction cannot be guaranteed, though every effort will be made to align with client intent.

2.2 Revision Policy

Each package includes a specific number of revisions:

Tier 1: Two minor revisions

Tier 2: One minor revision

Tier 3: One light lyrical or mixing revision

All revision requests must be submitted within seven (7) days of delivery.
Substantial creative redirection (new concept, new lyrics, or new production style) will require a new project agreement.

3. Payment and Refunds

3.1 Payment Terms

All payments are securely processed through PayPal or other approved methods.
Projects commence only after payment has been received.

3.2 Non-Refundable Deposit

Due to the personalized and creative nature of our work, all payments are final and non-refundable once creative production begins.

3.3 Refund Exceptions

Refunds may be considered only if EchoNomadLyric fails to deliver a final product due to unforeseen internal circumstances. Refunds are not issued for subjective dissatisfaction or creative differences.

4. Ownership and Usage Rights

4.1 Copyright and Intellectual Property

Unless otherwise specified in a signed, written agreement, EchoNomadLyric retains full ownership, copyright, and master rights to all songs, compositions, recordings, artwork, and associated materials.
This includes all derivative works, mixes, and instrumental stems.

4.2 Client License

Upon final delivery, clients are granted a limited, non-exclusive, perpetual license to use their custom song for personal and promotional purposes (e.g., social media, weddings, personal videos).
Commercial, public, or broadcast usage—including monetized content, advertisements, or brand campaigns—requires a separate commercial licensing agreement.

4.3 Ownership Transfer

Ownership of master and publishing rights can be transferred only through a written, mutually signed agreement.
Additional fees will apply based on the scope of usage, distribution plans, and publishing rights involved.

4.4 Distribution and Promotion

Clients authorize EchoNomadLyric to promote, publish, or distribute the work for portfolio, social media, or streaming purposes unless a confidentiality clause has been requested in writing prior to production.

4.5 Third-Party Content and Permissions

By submitting information, stories, or references, the client confirms they have obtained any necessary permissions from individuals or entities mentioned in the content. Public release implies full consent from all parties involved.

5. Nomad Partnerships (Referral Commissions)

5.1 Commission Eligibility

Registered Nomad Partners or approved referral collaborators are eligible for commissions based on successful client referrals that result in completed projects and full payment by the client.

5.2 Commission Payment Terms

All commissions are paid in full within seven (7) days of receiving the final payment from the client.
Payments are made via PayPal or other agreed-upon method.

5.3 Commission Calculation

Commissions are calculated as the percentage agreed upon between EchoNomadLyric and the referring partner, less any applied discounts, credit card processing fees, and applicable taxes.

5.4 Partner Responsibilities

Partners must represent EchoNomadLyric accurately, without misrepresentation or unapproved offers. Any misuse of brand materials or false claims may result in immediate termination of partnership and forfeiture of pending commissions.

5.5 Independent Contractor Status

All Nomad Partners are independent contractors, not employees or agents of EchoNomadLyric.
No employment relationship, benefits, or ongoing obligations are implied.

6. Liability and Limitations

6.1 Service Limitations

EchoNomadLyric is not liable for dissatisfaction due to creative subjectivity, client miscommunication, or differing interpretations of artistic intent.

6.2 Delays and Delivery Issues

EchoNomadLyric is not responsible for project delays caused by lack of client response, missing information, or late approvals.

6.3 Technical Failures

Clients are responsible for maintaining backup copies of delivered materials. EchoNomadLyric is not liable for file loss after delivery.

7. Privacy Policy

7.1 Information Collection

EchoNomadLyric collects personal data (name, contact information, project details, stories, and creative references) solely for the purpose of fulfilling and managing commissioned works.

7.2 Data Protection

All data is securely stored and never sold, rented, or disclosed to unauthorized parties.
Data access is limited to EchoNomadLyric and essential service providers (e.g., payment processors, hosting services) who operate under confidentiality agreements.

7.3 Confidentiality and Consent

Clients maintain control over what personal details are shared publicly.
By submitting content, clients consent to its use in song creation. Any public sharing or portfolio display will occur only with prior permission.

7.4 Cookies and Analytics

The EchoNomadLyric website may use cookies and third-party analytics tools to enhance user experience and monitor engagement. Visitors can disable cookies in browser settings.

7.5 Data Retention

Personal and creative data are retained for recordkeeping and copyright purposes unless deletion is requested in writing.

7.6 Data Deletion Requests

Clients may request permanent deletion of their personal data by contacting echonomadlyric@gmail.com. Deletion requests will be processed within 30 days unless retention is required for legal or financial obligations.

8. Dispute Resolution

8.1 Arbitration Agreement

Any disputes arising from these Terms will be resolved through binding arbitration in the State of Florida. Arbitration shall be conducted under recognized arbitration rules.

8.2 Governing Law

These Terms are governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict of laws principles.

8.3 Legal Fees

In any dispute, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.

9. Modifications and Updates

EchoNomadLyric reserves the right to update or modify these Terms and the Privacy Policy at any time. Material changes will be announced via email or website notice. Continued use of the service after updates constitutes acceptance of the new terms.
